This bill amends the Air Quality Control Act to allow the Department of Environment to deny a permit application based on the applicant's poor compliance history. Specifically, the bill authorizes the department or local agency to deny a permit application if, within the past 10 years, the applicant has knowingly misrepresented material facts, refused to disclose required information, been convicted of environmental crimes or crimes related to trade, price fixing, bribery, or fraud, constructed or operated a facility without a required permit, or had a permit revoked or suspended. The bill also allows the department or local agency to issue a conditional permit to provide an opportunity for the applicant to demonstrate rehabilitation.
