Bill Summary
AN ACT to amend the penal law, in relation to criminal mischief in the third degree and criminal mischief in the second degree
AI Summary
This bill amends the Penal Law to increase the monetary threshold for criminal mischief in the third degree from $250 to $1,000 and for criminal mischief in the second degree from $1,500 to $3,000. It also removes the requirement for three or more prior convictions for criminal mischief offenses to be charged with criminal mischief in the third degree for damaging a motor vehicle. The bill is intended to update the monetary thresholds for these crimes to reflect the current value of property and address concerns about over-criminalization for relatively minor property damage.
