This bill specifies procedures for the closure and/or decertification of assisted living residences. It requires the operator to provide written notice to the appropriate regional office of the Department of Health prior to the anticipated closure date, and to submit a proposed plan for closure and/or decertification, which must be approved by the Commissioner. The plan must include timetables and describe the procedures for notifying residents, assessing their needs, assisting with relocation, and maintaining compliance until all residents have been relocated. The operator is prohibited from closing the residence or increasing fees prior to the approval of the closure plan, and must implement the approved plan to ensure arrangements are in place for the continued care of each resident. Failure to comply can result in civil penalties.
