This bill amends existing law to provide that emergency or disaster declarations shall not be considered a compelling governmental interest sufficient to restrict parental rights. This means that the government cannot use emergency declarations as a justification to override or interfere with fundamental parental rights, such as forced medical actions, removal of a child from the home, or other actions that could abridge parental rights. The bill also allows parents to assert violations of their fundamental rights as a claim or defense in a judicial proceeding and obtain appropriate relief against the government entity.
