Bill Summary

AN ACT RELATING TO TOBACCO PRODUCTS; CLARIFYING THAT MUNICIPALITIES AND COUNTIES MAY ENACT ORDINANCES, CHARTER AMENDMENTS OR REGULATIONS PERTAINING TO THE SALES OF TOBACCO PRODUCTS THAT ARE STRICTER THAN, BUT NOT IN CONFLICT WITH, THE PROVISIONS OF THE TOBACCO PRODUCTS ACT.

AI Summary

This bill clarifies that municipalities and counties in New Mexico can enact ordinances, charter amendments, or regulations pertaining to the sale of tobacco products that are stricter than, but not in conflict with, the provisions of the Tobacco Products Act. The bill amends the existing Tobacco Products Act to explicitly state that nothing in the Act prohibits local governments from passing more stringent tobacco sale regulations, as long as they do not directly conflict with the state-level law.
