This bill provides judicial discretion in imposing habitual offender sentencing enhancements and excludes simple possession offenses from the definition of "prior felony conviction" for the purposes of the habitual offender statute. Specifically, the bill allows judges to increase the basic sentence of a habitual offender by up to one, four, or eight years, rather than mandating the sentence enhancement. Additionally, the bill excludes convictions for felony DUI and simple possession of controlled substances from counting as a "prior felony conviction" for the habitual offender statute.
