This bill aims to promote parity of regulation and encourage a broadband-focused competitive telecommunications market in New Mexico. Key provisions include: 1. Requiring the Public Regulation Commission (PRC) to adopt rules by December 31, 2021, to accelerate the transition away from a regulated telecommunications industry and encourage a broadband-focused competitive market, while preserving certain rights and obligations established under federal and state law. 2. Modifying the criteria for determining "effective competition" for regulated telecommunications services, including presuming effective competition in wire center serving areas where the incumbent local exchange carrier provides basic local exchange service to less than half of the housing units and business firms. 3. Replacing the application process for individual service contracting with a requirement for providers to retain such contracts for a minimum of two years after expiration or termination. 4. Mandating that providers cannot use individual contracts to offer services on materially different terms to similarly situated customers without permission. 5. Expanding the triennial reporting requirements for the PRC to include information on steps taken to implement parity of regulation and wire centers no longer subject to carrier of last resort obligations. 6. Repealing a section related to definitions and policy under the New Mexico Telecommunications Act.
