This bill creates the crimes of abandonment and abuse of a child with a disability in New Mexico. The bill increases the penalties for abandoning or abusing a child with a disability, making it a fourth-degree felony for abandonment and a second-degree felony for abuse on the first offense. It also creates a presumption that a parent, guardian, caretaker, or person charged with the care of a child knows if the child has a disability, which can be rebutted by evidence that the person did not know or should not have known about the child's disability.
