This bill prohibits the performance of or attempt to perform an abortion, except when necessary to save the life of a pregnant woman in a medical emergency. The bill defines "abortion" and "unborn child" as per existing law, and "medical emergency" as a condition that cannot be remedied by delivery of the child, where an abortion is necessary to preserve the life of the pregnant woman. The bill imposes penalties of up to $100,000 in fines and up to 10 years in prison for violations, but it does not authorize the charging or conviction of a woman for the death of her own unborn child. The bill also provides an affirmative defense for licensed physicians who provide medical treatment to a pregnant woman that results in the accidental or unintentional injury or death of the unborn child.
