This bill establishes the offense of possessing a loaded firearm while intoxicated as a petty misdemeanor. It defines intoxication as having a blood alcohol content of 0.08 or more, or being under the influence of alcohol enough to impair normal mental faculties or the ability to operate a firearm safely. The bill specifies that the person must be in possession of the loaded firearm outside their dwelling. The bill does not affect any existing rights, duties, penalties, or proceedings, and the new law would take effect on July 1, 2021.
