This bill amends New Mexico law to designate the Homeland Security and Emergency Management Department as the state agency responsible for overseeing compliance with the National Flood Insurance Program (NFIP). It requires state-owned or state-funded developments to obtain floodplain review by a certified professional and obtain required permits prior to starting construction. Additionally, these developments must comply with the most stringent local and state floodplain management regulations. The bill also designates the Construction Industries Division as the state agency responsible for reviewing, permitting, and enforcing floodplain management rules for state-owned or state-funded buildings. The provisions of the bill will take effect on July 1, 2022.
