This bill creates the crime of "damage to property by theft or attempted theft of regulated material" in the Criminal Code of New Mexico. The bill defines "regulated material" to include specific types of metal, such as aluminum, bronze, copper, brass, and steel, as well as certain utility and infrastructure items. Under this new law, if the cost to repair the damage caused by the theft or attempted theft of these regulated materials exceeds $2,500, the offender is guilty of a fourth-degree felony and must provide restitution to the owners of the regulated material and any damaged property.
