This bill requires public and private post-secondary educational institutions in New Mexico that receive state funds for student financial assistance to adopt detailed, trauma-informed policies and procedures for investigating and responding to allegations of sexual assault, domestic violence, dating violence, harassment, and stalking. The bill establishes an affirmative consent standard for sexual activity, requires institutions to conduct biennial sexual misconduct climate surveys, and tasks the Higher Education Department with developing a data repository and rules for the implementation of these requirements. The bill also amends the Public School Code to include a requirement for schools to teach affirmative consent as part of health education courses for students.
