Bill Summary
AN ACT RELATING TO EMERGENCY POWERS; PROVIDING THAT A DECLARATION OF A STATE OF EMERGENCY PURSUANT TO THE ALL HAZARD EMERGENCY MANAGEMENT ACT OR THE PUBLIC HEALTH EMERGENCY RESPONSE ACT TERMINATES AFTER NINETY DAYS UNLESS THE GOVERNOR CALLS THE LEGISLATURE INTO SPECIAL SESSION TO ADDRESS THE CIRCUMSTANCES OF THE EMERGENCY; AMENDING AND ENACTING SECTIONS OF THE NMSA 1978; DECLARING AN EMERGENCY.
AI Summary
This bill would limit the duration of emergency declarations issued by the governor under the All Hazard Emergency Management Act and the Public Health Emergency Response Act. It would require the governor to call the legislature into special session within 90 days of the initial declaration in order for the emergency to continue beyond that period. The legislature would then be able to restrict, suspend, or terminate the emergency declaration by joint resolution. The governor would also be limited to declaring only one emergency per event, requiring the legislature's consent for any subsequent declarations related to the same event.
