This bill amends the Civil Practice Law and Rules to allow a plaintiff who has obtained a judgment against a defendant to directly recover the unsatisfied portion of that judgment from a co-defendant or third-party defendant who has been found liable to the original defendant for contribution or indemnification. The plaintiff can either collect directly from the co-defendant or third-party defendant, or take an assignment of the original defendant's claim against the co-defendant or third-party defendant and pursue it in their own name. This provides the plaintiff with an additional means to enforce their original judgment, but does not apply in circumstances where the third-party claim would have been barred by the Workers' Compensation Law.
