This bill establishes requirements for the transfer, discharge, and voluntary discharge of residents from residential health care facilities in New York. It prohibits facilities from transferring or discharging a resident unless it is necessary for the resident's health, safety, or welfare, or to preserve the health, safety, or welfare of other residents. It requires facilities to use their best efforts to secure appropriate placement or residential arrangements for the resident, other than temporary housing assistance, before initiating a transfer or discharge. The bill also provides protections for residents who choose to voluntarily transfer or discharge, including the right to remain in care unless appropriately discharged or transferred in accordance with the law.
