This bill amends the Penal Code to require bail to be set at $0 for all offenses except serious or violent felonies, violations of protective orders, domestic violence, sex offenses, DUIs, and other specified crimes. The Judicial Council is required to prepare and annually revise a statewide bail schedule for these exempt offenses. The bill also prohibits costs related to conditions of release on bail from being imposed on persons released on bail or on their own recognizance. Additionally, the bill requires the court to order the return of money or property paid to a bail bond licensee in certain circumstances, such as when charges are dismissed or the arrestee made all court appearances, with the licensee allowed to retain a surcharge of up to 5% of the amount paid.
