This bill requires assisted living facilities in South Dakota to create and post visitation policies. The bill provides that each resident has the right to receive visitors of their choosing, subject to reasonable clinical and safety restrictions. Assisted living facilities must post their visitation policies on their website and in a conspicuous place within the facility, and provide copies to residents and their designated family members. If visitation policies need to be limited or restricted due to federal or state laws or best clinical practices during a health emergency, the facility must inform residents and their designated family members, provide the rationale, and review the limitations and restrictions every 30 days. The bill also requires facilities to post guidance documents from the Department of Health related to visitation restrictions during a health emergency.
