This bill prohibits a person from being required to join a labor organization or pay any labor organization dues or fees as a condition of employment or continuation of employment, notwithstanding any state law to the contrary. It establishes the "Right to Refrain" from joining a union and paying union dues or fees, and provides penalties, injunctive relief, and damages for violations. The Attorney General is responsible for enforcement and must prosecute all violations. The bill includes exceptions for employers and employees covered by the federal Railway Labor Act, federal employers and employees, and those on federal enclaves where federal law preempts or conflicts with the provisions of this chapter.
