This bill makes several changes to the Extreme Risk Firearm Protection Order Act in New Mexico. It allows certain law enforcement officers to file a petition for an extreme risk firearm protection order without receiving information from a reporting party. The bill also requires law enforcement to take possession of any firearms relinquished by a respondent under the order. It changes the reporting requirements, including requiring the courts to transmit information about the order to the National Instant Criminal Background Check System. Additionally, the bill prohibits the use of evidence establishing firearm ownership or possession presented in an extreme risk firearm protection order hearing from being used in any criminal proceeding, and prohibits a petitioner subject to an extreme risk firearm protection order from obtaining a new firearm until the order expires.
