This bill requires school districts in New Mexico to maintain a special education services fund, where they must allocate a portion of their special education funding received through the state equalization guarantee formula. The funds can be used to provide assistance and reimbursement to families of special education students with individualized education programs who have paid out-of-pocket for services that the school district did not provide during the COVID-19 public health emergency. Families must provide detailed receipts and service contracts to the school district to receive reimbursement, which cannot exceed the amount the student generated from the special education program unit. The provisions of this act are effective from the date of enactment until the termination of the state's COVID-19 public health emergency.
