This bill increases the statutes of limitations for criminal sexual penetration and criminal sexual contact of a child. Specifically, it allows prosecution to commence at any time after the occurrence of the crime until the alleged victim reaches the age of 35 for crimes against a minor under Section 30-9-11 NMSA 1978 (criminal sexual penetration of a child). For crimes against a minor under Section 30-9-13 NMSA 1978 (criminal sexual contact of a child), the prosecution can commence at any time after the occurrence of the crime until the alleged victim reaches the age of 30. Additionally, the bill removes the statute of limitations for capital felonies or first-degree violent felonies, allowing prosecution to commence at any time after the occurrence of the crime.
