This bill makes several changes to the Energy Transition Act: 1. It reinstates the New Mexico Public Regulation Commission's regulatory authority over public utilities for plant abandonment costs, to protect ratepayers. 2. It amends the Renewable Energy Act to clarify that the Commission may require a public utility to discontinue serving customers in New Mexico with a generation facility that has carbon dioxide emissions, as long as the utility can recover its undepreciated investments and decommissioning costs. 3. It modifies the requirements for the Commission to approve a financing order under the Energy Transition Act. The Commission may now advise the utility of changes needed to comply with the Act, rather than being required to approve the order once the changes are made. The Commission must also find that the proposed energy transition cost recovery through bonds provides greater benefits to ratepayers than alternative approaches, and that the costs and rates are fair, just, and reasonable. 4. It extends the deadlines for requesting a rehearing and filing an appeal of a financing order from 10 calendar days to 30 calendar days, to better align with standard court rules.
