AI Summary

This bill makes several key changes to child support provisions in New Mexico: - It allows courts to impute income to a parent who is willfully unemployed or underemployed, with certain criteria to be considered. - It specifies that incarceration cannot be treated as voluntary unemployment for the purposes of child support. - It requires justification for any deviation from the child support guidelines, and creates a Child Support Guidelines Review Commission to periodically review the guidelines. - It provides that the health care needs of a minor child are an adequate basis for modification of a child support order. - It changes references in the Mandatory Medical Support Act from "health insurance" to "health care coverage" and from "insurers" to "carriers". - It limits fees relating to adjudicating parentage to be paid within 3 years, and limits retroactive child support to 3 years. The bill aims to ensure consistent application of child support guidelines, account for incarceration and health care needs, and improve enforceability and administration of child support orders.
