This bill prohibits smoking in private passenger cars, vans, and trucks where a minor under 14 years of age is a passenger. It provides a rebuttable presumption that someone holding a lighted tobacco or other smoking product near a minor is engaged in smoking. Violations of this provision are subject to a fine of up to $100, which can be imposed by any enforcement officer. The bill also amends the existing law to clarify that the smoking prohibition applies to private automobiles, except as provided in the new section prohibiting smoking in vehicles with minor passengers.
