This bill requires the county commissioners or county council to approve a referendum request if a valid petition is presented by at least 40% of the registered voters in the area proposed to be incorporated as a municipality. If the referendum request is approved, the county commissioners or county council must specify a day and time for a vote by the residents of the area on the proposed municipal charter. If the referendum request is rejected, the county commissioners or county council must provide written reasons for the rejection and establish procedures for reconsidering the request, including a public hearing. The bill takes effect on October 1, 2021.
