This bill amends and adds to existing law to authorize the possession, distribution, transportation, and use of cannabis for medical purposes, to impose an excise tax on medical cannabis and medical cannabis devices, and to provide that marijuana and tetrahydrocannabinols or synthetic equivalents are Schedule II controlled substances. Specifically, the bill establishes the "Sergeant Kitzhaber Medical Cannabis Act" which authorizes the possession, distribution, transportation, and use of cannabis and cannabis products for medical purposes within certain limits. It creates an electronic verification system to track medical cannabis cardholders and sales. The bill defines qualifying medical conditions, registration and training requirements for practitioners, and protections for medical cannabis use. It establishes a Qualified Patient Enterprise Fund to fund the program. The bill also imposes a 2% excise tax on the sale of medical cannabis and medical cannabis devices, and reclassifies marijuana and tetrahydrocannabinols as Schedule II controlled substances.
