This bill establishes a reporting mechanism and assignment of a prosecutor following the use of deadly force by a peace officer resulting in great bodily harm or death. It requires the sheriff or police chief to report such incidents to the district attorney within 24 hours, and the district attorney to then report to the governor and attorney general. The relevant prosecuting authority will represent the state in a probable cause hearing, and the Department of Public Safety will be the default primary investigative agency. The prosecuting authority will determine if there is criminal liability and provide quarterly updates and a detailed report on any declination of prosecution. The attorney general will have concurrent jurisdiction to prosecute unlawful uses of deadly force.
