This bill amends the existing law in New Mexico to allow for the disclosure of electronic health care information for treatment, payment, and health care operation activities, as long as it complies with the federal Health Insurance Portability and Accountability Act (HIPAA) and related regulations. The bill specifies that providers and health care institutions can disclose information to a record locator service or health information exchange for the development and operation of those systems. It also requires the maintenance of audit logs for access to the information and allows individuals to exclude their information from the record locator service. The bill becomes effective on July 1, 2021.
