Bill Summary

A bill to prohibit local units of government from enacting or enforcing any law, ordinance, policy, or rule that limits local officials, officers, or employees from communicating or cooperating with appropriate federal officials concerning the immigration status of individuals; to prescribe the powers and duties of certain state and local officers, officials, and employees; and to prescribe penalties and remedies.

AI Summary

This bill, known as the "Local Government Sanctuary Policy Prohibition Act," prohibits local units of government, such as cities, villages, and townships, from enacting or enforcing any law, ordinance, policy, or rule that limits or prohibits local officials from communicating or cooperating with federal officials regarding the immigration status of individuals. If a local unit of government has an existing law, ordinance, policy, or rule that violates this act, they must bring it into compliance within 60 days. After that, residents of the local unit of government can take legal action or file a complaint with the attorney general, who can then bring an action to enforce the act. If the court determines that a law, ordinance, policy, or rule violates this act, it can issue an injunction, order the local unit of government to amend or repeal the offending provision, and award damages, costs, and attorney fees to the party challenging it. Additionally, the court can impose a civil fine of $2,500 to $7,500 on any elected or appointed official who knowingly and willfully enacted or enforced a law, ordinance, policy, or rule in violation of this act.
