This bill proposes a constitutional amendment that changes the process for filling a vacancy in the office of the lieutenant governor. Under the current law, the last elected presiding officer would become the lieutenant governor in case of a vacancy. The proposed amendment would require the governor to appoint a person to fill the vacancy, with the advice and consent of the state senate and house of representatives. The governor must make the appointment within 30 days, and the legislature must act on the appointment within 30 days. If the legislature is not in session, the governor must call a special session for this purpose. The amendment also specifies that if the governor appoints a legislator, the legislator must resign their legislative office upon accepting the appointment.
