This bill requires public elementary and secondary schools in West Virginia to ensure that athletes participate in sports based on their biological sex as indicated on their original birth certificate. If an athlete's birth certificate does not specify biological sex, the school must require genetic testing to determine the athlete's chromosomal makeup. The bill also immediately makes a school ineligible to receive public funding if it violates these requirements, and allows the Attorney General to bring civil actions against state or local officials who intentionally violate or try to undermine the law, with potential penalties of up to $10,000 and a five-year ban from holding public office.
