This bill amends Section 654 of the California Penal Code to allow an act or omission that is punishable in different ways by different laws to be punished under either of those provisions, rather than requiring it to be punished under the law that provides for the longest possible term of imprisonment. The bill specifies that an acquittal or conviction and sentence under one provision bars a prosecution for the same act or omission under any other provision, and that a defendant sentenced under this section shall not be granted probation if any of the applicable provisions prohibits the granting of probation.
