This bill amends existing law to revise provisions regarding a declaration of disaster emergency by the Governor. The key provisions are: 1. The Governor can only issue executive orders or proclamations declaring a state of disaster emergency if he finds a disaster has occurred or is imminent, and the orders/proclamations must be essential to protect life or property. The orders/proclamations cannot universally restrict job holders by type or classification. 2. A declared state of disaster emergency is limited to 60 days, unless the Legislature extends it up to 365 days by concurrent resolution. The Governor cannot circumvent the 60-day limit by repeatedly redeclaring the same emergency. 3. The Legislature can terminate a state of disaster emergency at any time through concurrent resolution or other legislative action. 4. The Governor cannot impose or enforce additional restrictions on firearms/ammunition or limit other constitutional rights during a state of disaster emergency. The Governor also cannot alter, adjust, or suspend any provision of the Idaho Code during such an emergency.
