This bill amends existing law to provide that the Department of Health and Welfare shall file a contempt affidavit with the court that issued a child support order if the delinquency is at least $5,000 and the department has evidence that the obligor has the ability to make the payments. The bill also provides that an obligor found in contempt of a child support order with a delinquency of at least $10,000 cannot petition to modify child custody until the delinquency is reduced to less than $10,000, the obligor has satisfied the support order for the last 12 months, and the obligor has successfully completed a 12-month probation program established by the department.
