This bill amends Section 1430 of the California Health and Safety Code to authorize the legal representative, personal representative, or successor in interest of a current or former resident or patient of a skilled nursing facility or intermediate care facility to bring a civil action against the facility's licensee for any violations of the resident's or patient's rights. For violations that occur on or after March 1, 2021, the bill increases the maximum civil damages from $500 per action to $500 per violation, and requires certain factors to be considered in assessing the amount of damages, such as the nature and seriousness of the violation and the facility's efforts to prevent the violation.
