This Joint Resolution establishes the Heirs' Property Study Committee to investigate current and future ways to resolve issues related to heirs' property in South Carolina. Heirs' property refers to land passed down informally through generations without clear legal ownership, which can lead to problems with taxes, land use, and selling the property, and disproportionately affects African American landowners. The committee, composed of six members of the General Assembly (three from the Senate and three from the House of Representatives), will determine the extent of heirs' property in the state, study the effects of existing laws, analyze successful approaches from other states, and assess the economic costs and benefits of addressing this issue. The committee is also tasked with seeking input from various government agencies and private sector organizations, and it must submit a report to the General Assembly by December 31, 2022, after which it will be dissolved.
