This bill, the Private Detention Facility Moratorium Act, prohibits the operation of private detention facilities in New Mexico, except for those operating under valid agreements entered into prior to the enactment of this law, and only until the end of 2026. It also prohibits the state or any governmental entity from entering into, renewing, or modifying agreements with private entities for the detention of individuals or from subsidizing the costs of private detention facilities. The bill creates two funds - the Detention Facility Economic Development Assistance Fund and the Detention Facility Displaced Worker Assistance Fund - to assist affected communities and displaced workers, and requires the establishment of community advisory committees to provide recommendations on the use of these funds. The bill also makes various amendments to existing laws related to the operation and management of correctional and detention facilities in the state.
