This bill narrows the exceptions to immunity for law enforcement officers under the Tort Claims Act in New Mexico. Specifically, it removes the exceptions for the independent torts of negligent spoliation of evidence and intentional spoliation of evidence, as well as the exception for failure to comply with duties established by statute or law. The bill keeps the exceptions for liability resulting from assault, battery, false imprisonment, false arrest, malicious prosecution, abuse of process, libel, slander, defamation of character, violation of property rights, and deprivation of constitutional or statutory rights. The definition of "law enforcement officer" is also provided.
