This bill increases certain mandatory minimum sentences for criminal sexual offenses against children. It amends the law to increase the mandatory minimum sentence for criminal sexual penetration and criminal sexual contact of a minor from three years to five years. The bill also increases the sentencing enhancements for habitual offenders, raising the sentence increases from one year to two years for one prior felony, four years to five years for two prior felonies, and eight years to nine years for three or more prior felonies. The bill provides exceptions where the court can depart from the mandatory sentence if the prior and current felonies are nonviolent and there are substantial and compelling reasons.
