This bill, the Medical Device Right to Repair Act, would require original manufacturers of powered medical equipment to provide hospitals and independent repair providers engaged by hospitals with the documentation, parts, service access methods, and tools needed to inspect, diagnose, maintain, and repair the equipment on fair and reasonable terms. The bill defines "fair and reasonable terms" and exempts trade secrets from the required disclosures. It subjects original equipment manufacturers who violate these provisions to civil penalties that increase with each violation. The bill applies to medical equipment sold or in use in California on or after January 1, 2022.
