This bill adds a new section to existing Idaho law to establish provisions regarding the prevention of a child's removal from the custody of a parent or guardian under certain circumstances. Specifically, the bill prohibits the Department from making a substantiated disposition that a child has been abused, neglected, or abandoned by a parent or guardian due to a request for inpatient hospital treatment or out-of-home placement for the child, if the child's recent mental health condition demonstrates they are likely to cause harm to themselves or others, and the risk cannot be eliminated before returning the child to their family. The bill also requires the Department to enter into an interagency agreement to establish an interagency clinical team to review cases of children at the hospital or similar treatment facility and connect them and their family with appropriate services, treatment, and support to stabilize the child's serious emotional disturbance and prevent removal by the Department.
