This bill, known as the Veterans 2nd Amendment Protection Act, proposes to amend Title 38 of the United States Code to prohibit the Secretary of Veterans Affairs from transmitting personally identifiable information of a beneficiary to the Department of Justice for use by the National Instant Criminal Background Check System, unless there is a judicial order or finding that the beneficiary is a danger to themselves or others. This would prevent the automatic reporting of veterans who have been determined to require a fiduciary to manage their benefits to the background check system, which could otherwise result in the loss of their right to possess firearms.
