Legislative Counsel's Digest: Under existing federal law, it is the policy of the United States to promote the 1 adoption and observance of uniform time within prescribed standard time zones. 2 (15 U.S.C. 260 et seq.) Existing federal law also requires the annual 3 advancement of the standard time for each zone by 1 hour commencing at 2 a.m. on 4 the second Sunday of March and ending at 2 a.m. on the first Sunday of November, 5 commonly referred to as daylight saving time. Under existing federal law, a state 6 may by state law exempt itself and its political subdivisions from the provisions 7 requiring the advancement of time and observe the prescribed standard time for the 8 zone for the entire calendar year. However, a state is preempted from observing 9 daylight saving time as the standard time for the entire calendar year. (15 U.S.C. 10 260a) Section 2of this bill requires, to the extent not inconsistent with federal law 11 or if otherwise authorized by federal law, the State of Nevada and all political 12 subdivisions thereof to observe Pacific daylight time as the standard time for the 13 entire calendar year. Furthermore, section 5of this bill provides that this 14 requirement will become effective if and only if the State of California enacts 15 legislation to observe Pacific daylight time as the standard time for the entire 16 calendar year and such legislation is not inconsistent with or is otherwise 17 authorized by federal law. Section 3of this bill exempts the State of Nevada from 18 the provisions of federal law providing for the advancement of time between March 19 and November of each year and instead requires that during this period the State 20 and its political subdivisions observe Pacific standard time, thereby making Pacific 21 standard time the standard time for the entire calendar year. Furthermore, section 522 provides that this requirement will become effective if and only if the State of 23 California enacts legislation to exempt that state from the requirement of advancing 24 the time between March and November. 25 If the Congress of the United States is considering legislation authorizing the 26 State of California to observe Pacific daylight time as the standard time for the 27 entire calendar year or if the State of California has sent a public request for such 28 authorization to Congress, section 4of this bill requires the Governor of the State 29 of Nevada to send a letter to the President of the United States, the Vice President 30 of the United States as the presiding officer of the United States Senate, the 31 Speaker of the United States House of Representatives and each member of the 32 Nevada Congressional Delegation requesting that Congress authorize the State of 33 Nevada to observe Pacific daylight time as the standard time for the entire calendar 34 year if the State of California is granted such approval. If Congress enacts 35 legislation authorizing the State of California to observe Pacific daylight time as the 36 standard time for the entire calendar year and the State of Nevada is not included in 37 the legislation, section 4requires the Governor of the State of Nevada to send a 38 letter to the President of the United States, the Vice President of the United States 39 as the presiding officer of the United States Senate, the Speaker of the United States 40 House of Representatives and each member of the Nevada Congressional 41 Delegation requesting that Congress also enact legislation authorizing the State of 42 Nevada to observe Pacific daylight time as the standard time for the entire calendar 43 year. 44 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 234 of NRS is hereby amended by adding 1 thereto the provisions set forth as sections 2and 3of this act. 2 Sec. 2. To the extent not inconsistent with federal law or if 3 otherwise authorized by federal law, the State of Nevada and all 4 political subdivisions thereof shall observe Pacific daylight time as 5 the standard time for the entire calendar year. 6 Sec. 3. 1. The State of Nevada hereby exempts itself from 7 the provisions of 15 U.S.C. 260a requiring the advancement of 8 time during the period commencing at 2 a.m. on the second 9 Sunday of March of each year and ending at 2 a.m. on the first 10 Sunday of November of each year, commonly known as daylight 11 saving time. 12 2. During the period described in subsection 1, the State of 13 Nevada and all political subdivisions thereof shall observe Pacific 14 Standard time, the standard time applicable for the time zone in 15 which the State is situated in accordance with the provisions of 15 16 U.S.C. 260 et seq. 17 Sec. 4. 1. If the Congress of the United States is considering 1 legislation authorizing the State of California to observe Pacific 2 daylight time as the standard time for the entire calendar year or if 3 the State of California has sent a public request for such 4 authorization to Congress, the Governor of the State of Nevada shall 5 send a letter to the President of the United States, the Vice President 6 of the United States as the presiding officer of the United States 7 Senate, the Speaker of the United States House of Representatives 8 and each member of the Nevada Congressional Delegation 9 requesting that Congress authorize the State of Nevada to observe 10 Pacific daylight time as the standard time for the entire calendar 11 year if the State of California is granted such approval. 12 2. If the Congress of the United States enacts legislation 13 authorizing the State of California to observe Pacific daylight time 14 as the standard time for the entire calendar year and the State of 15 Nevada is not included in the legislation, the Governor of the State 16 of Nevada shall send a letter to the President of the United States, 17 the Vice President of the United States as the presiding officer of the 18 United States Senate, the Speaker of the United States House of 19 Representatives and each member of the Nevada Congressional 20 Delegation requesting that Congress also enact legislation 21 authorizing the State of Nevada to observe Pacific daylight time as 22 the standard time for the entire calendar year. 23 Sec. 5. 1. This section and section 4of this act become 24 effective upon passage and approval. 25 2. Section 2of this act becomes effective: 26 (a) If and only if the State of California enacts legislation that 27 provides for the observance of Pacific daylight time for the entire 28 calendar year and such legislation is not inconsistent with federal 29 law or is otherwise authorized by federal law; and 30 (b) On the effective date of such legislation. 31 3. Section 3of this act becomes effective: 32 (a) If and only if the State of California enacts legislation that 33 exempts that state from the provisions of 15 U.S.C. 260a requiring 34 the advancement of time during the period commencing at 2 a.m. on 35 the second Sunday of March and ending at 2 a.m. on the first 36 Sunday of November; and 37 (b) On the effective date of such legislation. 38
