This bill prohibits the Public Health and Health Planning Council and the Commissioner of Health from approving the establishment, incorporation, construction, or increase in capacity of for-profit nursing homes. However, it does not bar further action related to nursing homes that were already established, incorporated, or approved for construction as for-profit facilities prior to the effective date of this section, as long as the action does not result in an increase in the resident capacity of those nursing homes. The term "for-profit nursing home" is defined as a nursing home owned or operated, in whole or in part, by a for-profit entity.
