This bill amends the Texas Penal Code to modify the defenses available for certain offenses involving material or conduct that may be obscene or otherwise harmful to children. Specifically, it removes the affirmative defense that the sale, distribution, or exhibition of such material was for a scientific, educational, governmental, or similar justification. It also adds a defense for law enforcement officers acting in the course of their official duties. Additionally, the bill clarifies that the changes apply only to offenses committed on or after the effective date of the Act.
