This Joint Resolution states that the Idaho Legislature finds that a drug-free environment is essential for the health, safety, and welfare of its citizens, and that legalizing certain controlled substances would be harmful, especially in light of neighboring states' experiences. To address this, it proposes an amendment to the Idaho Constitution, specifically Section 26 of Article III, which currently grants the legislature authority over intoxicating liquors. The proposed amendment would add a provision stating that any controlled substance, as defined by the Idaho Uniform Controlled Substances Act on July 1, 2021, can only be legalized or removed from its current scheduling if approved by at least two-thirds of all members in both houses of the legislature, voting separately. This supermajority vote requirement is intended to prevent the legalization of such substances through a simple majority vote. The resolution also directs the Legislative Council and the Secretary of State to prepare and publish the necessary statements and arguments for this proposed amendment to be presented to the voters at the next general election.
