This Concurrent Resolution requests that the Judiciary, which refers to the court system, conduct a study to determine if it is necessary to automatically require all cases of alleged domestic abuse involving a child (a minor) or an adult who cannot care for themselves (an incapacitated person) to be reported to the Department of Human Services (DHS) for investigation or intervention. Currently, when a parent seeks a restraining order against an abusive household member and a child lives in the home, the court is already required to refer the case to the DHS, specifically its Child Welfare Services Branch, for assistance. Judges also have the discretion to refer cases to the DHS if they believe an investigation is needed to ensure the family's safety and provide support services. The resolution suggests that making these referrals mandatory in all such domestic abuse cases might not be necessary, given the existing procedures and judicial discretion, and therefore asks for a formal study to evaluate this. The Judiciary is asked to report its findings and any proposed legislative changes to the Legislature by a specific date before the 2023 legislative session.
