Bill Summary
AN ACT to amend the real property law, in relation to requiring disclosure of information concerning flood insurance on property condition disclosure statements; and to repeal section 467 of the real property law relating to liability with respect to property disclosures
AI Summary
This bill amends the real property law to require every residential lease to provide notice of information concerning the property's flood history and current flood risk. Specifically, the lease must disclose whether the property is located in a FEMA-designated floodplain, the Special Flood Hazard Area (100-year floodplain), or a Moderate Risk Flood Hazard Area (500-year floodplain), as well as whether the property has experienced any previous flood damage. The bill also requires the lease to include a notice informing tenants that flood insurance is available through the National Flood Insurance Program (NFIP) to cover personal property and contents in the event of a flood, as a standard renter's insurance policy typically does not cover flood damage.
