This bill provides liability protections for certain claims arising during a pandemic or other disaster or emergency. Specifically, it: 1) Amends the Civil Practice and Remedies Code to provide immunity from civil liability, except in cases of reckless conduct or intentional/willful/wanton misconduct, for physicians, healthcare providers, and first responders for acts or omissions related to or impacted by a pandemic disease or disaster declaration. This includes activities like screening, treating, or diagnosing patients; using medical equipment/supplies outside of normal use; and acts/omissions due to shortages of personnel, facilities, or resources. 2) Provides liability limitations for the design, manufacture, sale, or donation of certain products used during a pandemic emergency, such as personal protective equipment, medical devices, and cleaning supplies. 3) Limits liability for educational institutions that cancel or modify courses/programs due to a pandemic emergency. 4) Establishes requirements for expert reports and other procedures related to claims alleging exposure to a pandemic disease. The bill also includes legislative findings and purposes to support these liability protections.
